Form I-508: Request for Waiver of Certain Rights, Privileges, Exemptions and Immunities

Form I-508, Request for Waiver of Certain Rights, Privileges, Exemptions and Immunities, is the form a non-U.S. citizen working for a foreign government mission or international organization uses to give up the diplomatic rights, privileges, exemptions and immunities tied to their job. USCIS says this includes any exemption from paying U.S. income taxes on salaries paid by the foreign government or organization.

It applies to people employed in an occupational status that would entitle them to A, G or E nonimmigrant status who are lawful permanent residents or are seeking adjustment of status to permanent residence. The USCIS page says that under INA section 247(a), a permanent resident in such a position who does not execute Form I-508 is adjusted to A, G or E nonimmigrant status, and that adjustment applicants who do not execute it are ineligible to adjust status.

The form is four pages long. The instructions say that as permanent residents, filers are or will be ineligible for the diplomatic rights and immunities their sending country, office or organization held on their behalf.

How to fill out Form I-508

  1. 1

    Use the 04/16/24 edition

Type or print in black ink. The USCIS page says the edition date and page numbers need to be visible on every page of a printed copy, and all pages need to come from the same edition.

  2. 2

Complete Part 1, including your PID and employer

Enter your State Department-issued PID in Item 5 and the name and address of your mission or organization in Item 9. If your mailing and physical addresses differ, give the physical address in Item 8.

  3. 3

Write your name into the Part 2 statement

Part 2 is a single statement. Your name goes in the blank at the start of Item 1.

  4. 4

    Answer every question

The instructions say to write N/A where a question does not apply and None for a zero. Extra answers go in Part 6 with your name, A-Number, and the page, part and item number, and each extra sheet is signed and dated.

  5. 5

    Sign Part 3

The instructions say a stamped or typewritten name is not accepted. A parent or legal guardian may sign for someone under 14. This page lets you fill the form online free, then print it for signature.

  6. 6

Have helpers complete Parts 4 and 5

An interpreter completes Part 4 and a preparer completes Part 5. The instructions say a person who acted as both completes both parts.

Where to file, evidence and fees

Where to file

The USCIS page says to file Form I-508 with your local USCIS office, unless you are filing it at the same time as Form I-131, in which case it goes to the same office as the Form I-131. Adjustment of status applicants file it with the same office as their Form I-485.

Fee

The fee is on the USCIS Fee Schedule page, and the instructions point to Form G-1055. Fees can change, so check it on the day you file.

Evidence and translations

The instructions say to send the evidence listed in them at the time of filing. A foreign-language document needs a full English translation with the translator's signed certification and contact information.

Copies and signatures

Send legible photocopies unless an original is requested. USCIS treats a photocopy, fax or scan of the original handwritten signature as valid for filing.

Common mistakes

The USCIS page says it rejects any unsigned form, and may reject a form with missing pages or pages from a different edition.
