2025 Form 709-NA: U.S. Gift (and GST) Tax Return of Nonresident Not a Citizen

Form 709-NA, United States Gift (and Generation-Skipping Transfer) Tax Return of Nonresident Not a Citizen of the United States, is the gift tax return for donors who are neither domiciled in nor citizens of the United States. The IRS About page says it reports certain transfers by nonresidents not citizens of the United States that are subject to the federal gift and certain generation-skipping transfer (GST) taxes, figures the tax due, if any, and allocates the lifetime GST exemption to property transferred during life.

This page covers the 2025 form, for gifts made during calendar year 2025. Page 1 holds the donor's general information and the tax computation. Schedule A lists the gifts, Schedule B lists gifts from prior periods and Schedule D figures the GST tax. The instructions say the gift tax generally applies to gifts of real or tangible personal property situated in the United States.

The What's New section says Form 709-NA can now be filed electronically through Modernized e-File (MeF). You can fill out Form 709-NA free in your browser on this page and download it without an account.

An extension for the 2025 income tax return (Form 4868 or Form 2350) also extends the gift tax return. Otherwise, Form 8892 requests an automatic 6-month extension. Neither extends the time to pay.

Who files Form 709-NA?

  • Nonresident donors of U.S. property

The instructions say a nonresident not a citizen (NRNC) who gave gifts of real or tangible personal property in the United States totaling more than the $19,000 annual exclusion probably files.

  • Gifts to a non-citizen spouse

For a spouse who is not a U.S. citizen, the instructions put the annual exclusion at $190,000 and say a return is filed when 2025 gifts to that spouse exceed it.

  • Future interest gifts

The instructions say gifts of future interests are not covered by the annual exclusion, so Form 709-NA is filed even when such gifts are under it.

  • Each spouse separately

Spouses may not file a joint gift tax return. A gift of community property is treated as made one-half by each spouse, and each files a return.

  • Executors

If a donor dies before filing, the instructions say the donor's executor files the return.

  • Who does not file

The instructions say no return is needed with no gifts to a spouse, no more than $19,000 to any one donee and only present interests, or, unless section 877(b) applies, gifts only of U.S. intangibles such as U.S. stock.

The donor completes and signs the return and sends it to the IRS. The instructions say only individuals are required to file gift tax returns, and that a paid preparer also signs.
